Abstract

This study aims to analyze the role of mediators in resolving family problems through an Acehnese customary approach in Darul Imarah Subdistrict, Aceh Besar. The study is motivated by the increasing rate of divorce, which has implications for family resilience and social stability. Formal mediation mechanisms through legal institutions are considered insufficiently effective; therefore, informal mediators grounded in customary law, religion, and community leadership play an important role in reducing family conflicts. This research employs a qualitative approach with a descriptive design. The focus of the study includes: the role of mediators in maintaining marital stability, the implementation of mediation based on Acehnese customary practices, and the supporting and inhibiting factors in the mediation process. Data were collected through observation, in-depth interviews, and documentation involving four mediators actively engaged in the research setting. The data were analyzed descriptively using an interpretative approach.

The findings indicate that informal mediators function as neutral parties who facilitate dialogue between disputing couples, assist in identifying the root causes of conflict, and offer alternative solutions grounded in religious and cultural values. The mediation process is characterized by its simplicity, low cost, and emphasis on familial harmony. Supporting factors include mediators’ social proximity to the community, cultural legitimacy, and procedural flexibility. Meanwhile, inhibiting factors include lack of good faith, high emotional tension, and a tendency to pursue formal legal channels. This study concludes that customary-based mediators in Aceh play a significant role in preserving family unity through culturally grounded and socially accepted approaches.
