Abstract

Polygamy is a legally and religiously regulated marital practice in Indonesia, particularly in Aceh Province, where Islamic law is formally implemented. The determination of polygamy permits by the Syar’iyah Court involves not only legal considerations but also social, economic, and psychological aspects that influence judicial decisions. This study aims to analyze the process of determining polygamy permits and to identify the factors influencing the approval or rejection of applications at the Lhokseumawe Syar’iyah Court. This research employed a qualitative approach with normative-empirical legal research. Data were collected through interviews, observations, and document analysis, and were analyzed descriptively. The findings indicate that the determination process follows a structured legal procedure, beginning with the submission of a written application and supporting documents, followed by mediation and judicial examination. In deciding cases, judges evaluate the legal grounds of the application, the applicant’s financial capacity, the ability to ensure fairness among wives, the consent and condition of the existing wife, the interests of children, and the potential social and psychological impacts on the family. Judicial decisions are based on the principles of justice, legal certainty, public benefit (maslahah), and family protection in accordance with Islamic law and Indonesian positive law. Consequently, the court applies strict scrutiny, ensuring that polygamy permits are granted only when all legal and substantive requirements have been satisfactorily fulfilled.
